PDP REQUEST SENATOR BEN AYADE ROMOVED FROM OFFICE OVER AGE CONTRADICTION

 
PDP goes against its own, as they ask the supreme court to sack the Cross River State Governor, Senator, Ben Ayade. The governor who won the governorship election under the Party's platform was dragged to court by his opponent who came second during the election with the allegation that he lied about his age.
 
Mr Agi who had earlier dragged Ben Ayade to Court last year but lost after Justice Abdul Kafarati, ruling on the suit on July 31, 2015, dismissed the case on grounds that the matter was not proved beyond reasonable doubt. That judgment was also upheld by three Court of Appeal Judges led by Justice Tinuade Akomolefe in subsequent rulings.

The PDP party, through its lawyer, N. Ibegbulam, told the Supreme Court headed by Justice Bode Rhodes Vivour that it was in support of the appeal filled by Mr Agi.

According to the evidence presented to the court by Agi, shows that The Governor, Senator Ben Ayade was born on March 2, 1969. as stated in his nomination form.

In another age declaration, which his brother, Frank Ayade swore to before a Cross River State High Court sitting on February 1, 2007, indicated that he (Ben Ayade) was born in 1968.

Further evidence tendered by Agi, shows that while the Governor was applying for admission into the University of Ibadan, his age declaration states that he was born on March 2, 1966.



The party's lawyer then requested that the governor shoul be removed from office. In his words " ‘My Lords, after due consideration, we apply to concede to this appeal and consequently apply to withdraw the 1st respondent’s brief of argument dated May 17. We urge your lordships to find merit in the appeal and apply Article 14(b) and 15(2) of the PDP Electoral Guidelines which disqualifies any candidate that gives false age declaration"

November 9th 2016 has been fixed for judgement by the Supreme court
Vanguard reports that the evidence before the court showed that Ayade stated on oath that he was born on March 2, 1969 in the nomination form with the code: PD 003/G, which he used to contest the election.
